Changes to Business and Industrial Zones

The NSW Government’s Department of Planning and Environment is currently exhibiting the translation of existing Business and Industrial zones into the new Employment zones.  The exhibition is being held on the Department’s Planning Portal for 6 weeks from 27 May 2022 to 12 July 2022.

This is the implementation stage of a reform that replaces Business and Industrial zones with Employment zones within individual local environmental plans across NSW. Amendments were made to the Standard Instrument (Local Environmental Plans) Order 2006 in December 2021 to facilitate the reforms. It is anticipated that the new zones will come into force on 1 December 2022.

What does this mean for Mosman?

Currently there are three business zones in Mosman Local Environmental Plan 2012 (the LEP) that apply to Mosman’s local and neighbourhood centres, and employment land (map). These are:

  • Zone B1 Neighbourhood Centre – applies to shops in Avenue Road, Mosman Bay Wharf, Parriwi Junction, Spofforth Street, and The Esplanade;
  • Zone B2 Local Centre – applies to the larger shopping precincts of Cremorne Junction, Mosman Junction and Spit Junction;
  • Zone B6 Enterprise Corridor – applies to commercial land along the Military Road corridor west of Spit Junction, and The Garrison retirement village.

The NSW Government’s reforms intend to replace these business zones with new employment zones:

  • Zone E1 Local Centre - this will apply to all land currently zoned B1 and B2 in Mosman;
  • Zone E3 Productivity Support - this will apply to all land currently zoned B6 in Mosman.

For each zone, the LEP identifies objectives and a range of permissible and prohibited land uses which apply to the land and regulate the types of development and scale considered to be suitable.

There will be some change to these under the NSW Government's reforms, and to provisions within the LEP to reference the new zones. In some instances, the changes are substantial - for example, broadening the range of permissible uses in neighbourhood centres and along the Military Road corridor. At the Council Meeting held on 1 March 2022, Council considered report EP/5 on the Employment Zone reforms and resolved "That strong advocacy be taken by Council against these proposed changes." The report can be viewed here.
